THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3475 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in S.C.No.92 of 2015 on the file of the V Additional District Judge, Karimnagar, arising out of an offence under Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Heard and perused the material.
The grounds raised by the learned counsel for the petitioners are necessarily to be tried by the trial Court. Hence, this Court is not inclined to quash the proceedings at this stage. However, as the question of identity of the accused does not arise, the presence of the petitioners before the trial Court is dispensed with except on the dates when the trial Court insists for their appearance. The petitioners are directed to be represented by a counsel on all hearing dates. The petitioners are given liberty to approach the Court below seeking discharge by raising all the grounds and the Court below is directed to consider the same and pass appropriate orders in accordance with law.
The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
