This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.2 to 5 in the event of their arrest in Crime No.129 of 2021 on the file of Station House Officer, Rajapur Police Station, Mahabubnagar registered for the offences punishable under Sections 193, 196, 420, 463, 464, 466, 468, 470, 47 l, 472, 473, 474, 120b read with Section 34 of Indian Penal Code. ?

Heard learned counsel for petitioners/Accused Nos. 2 to 5 and ) I learned Assistant Public Prosecutor for respondent-State. Perused the record.

3. The allegation against these petitioners is that they have fabricated documents and subsequently filed civil suits claiming the properties.

Learned counsel for the petitioners submits that the civil suits are already filed and the documents are subject matter and determination by the said civil courts in the said civil suits.

On the other hand learned Assistant Public Prosecutor submits that earlier the petitioners have adopted the same modus operandiin claiming the documents and creating litigations by filing cases before the Clvil Court.

In the said circumstances, the Criminal Petition is disposed off. However, the petitioners if so advised to surrender before the concerned Court and upon such surrender, the concerned Court shall ciispose off the application on merits, on the same day or the next day after giving opportunity of hearing to the public prosecutor, I As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
