THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2095 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following Order is passed:

Having regard to the fact that Charge sheet is filed against the petitioners for the offence under Section 498-A and Section 3 and 4 of Dowry Prohibition Act and as there is a prima facie case contained in the Charge sheet, it is not a fit case to quash the proceedings. Hence, the Petitioners have to face the trial putting forth all the defences legally available to them. However, considering the request of learned counsel for petitioners, the attendance of petitioners/Accused Nos. 2 to 4 in C.C.823 of 2014 on the file of Additional Judicial Magistrate of First Class, Anantapuram, is dispensed with except on the occasions when the trial Court requires their attendance. With the above observation, the Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
