Aggrieved by the action of the respondents in not allowing the petitioners to stay and study in Schedule Tribe IAS Study Circle, Manasa Hills, Rajendranagar, R.R.District, this Writ Petition is filed.
It is the case of the petitioners that they belong to Schedule Tribe Community; that in pursuant to G.O.Ms.No.459 dated 29.09.2017 for selection of 150 Schedule Tribe Candidates for Civil Services Coaching at Rajendranagar, the 2nd respondent called the petitioners and others for interview and also conducted screening test and they were selected for the said coaching for the year 2017-18 and the coaching classes shall start from 04.10.2017 as per the schedule for a period of one year; that the classes have been commenced three months later i.e., 01.01.2018; that the respondent officials and other staff along with police are threatening the petitioners to vacate the coaching centre and they have already stopped providing basic amenities like food, water & electricity for the last 15 days. Aggrieved by the same, petitioners made representation to the respondents 1 and 2, but no action is being taken.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for Social Welfare appearing on behalf of respondents.
Learned Assistant Government Pleader for Social Welfare produced written instructions stating that as per G.O.Ms.No.459, dated 21.09.2017, the Government had issued orders to organize UPSC civil coaching to 150 ST students of Telangana State at YTC and PETC building at Rajendranagar, Hyderabad for the year 2017-18 onwards by following certain guidelines prescribed for selection of Candidates etc. She submits that 113 ST candidates were admitted and studied in the institute basing on the marks and merit obtained in the Screening Test conducted by Dr.Ambedkar Open University, Hyderabad. She submits that the Government appointed the Chief Consultant who have vast experience in preparing schedule for completing syllabus, conducting exams, organizing classes with eminent faculty. She further submits that classes have been commenced from 06.10.
2017 and time table was prepared to conduct classes up to 30.06.2018 and that according to Chief Consultant's report, the classes were conducted with reputed faculty and syllabus was completed as per month wise schedule. She submits that the coaching program is for nine months to give guidance only to prepare for UPSC Civil Services Exams and afterwards the students have to prepare themselves with the guidance and also that the coaching is not for years together with hostel facility. She submits that some of the students are not real Civil Service aspirants and not attended classes of Civil Services and they used the institution for hostel purpose only and prepared for state level exams.
complaint to the respondents regarding the non-completion of the syllabus up to 8 months coaching period and after appearing Preliminary Exams on 03.06.2018, they are making all false allegations against the respondents.
In this case, it is to be seen that admittedly, Civil Services coaching in pursuant to G.O.Ms.No.459 is for a period of nine months. A perusal of written instructions produced by the learned Assistant Government Pleader for Social Welfare goes to show that coaching classes have been conducted and also completed the prescribed syllabus. That apart, in the writ affidavit, it is not stated that the prescribed syllabus is not completed by the respondents, but it is only stated that classes have been started on 01.01.2018. Admittedly, fresh notification for screening test for fresh batch of 2018-19 was issued on 05.07.2018.
In view of above facts and circumstances, no relief can be granted to the petitioners. However, it is open for the petitioners to apply in response to the fresh notification issued on05.07.2018 for the batch of 2018-19, if they are otherwise eligible for the same.
Accordingly, this Writ Petition is disposed of. There shall no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-07-2018 kvs
