This writ petition is filed challenging the action of the 2nd respondent in not investigating and filing charge sheet in Crime No.362/2017 of Suryaraopeta Police Station, Vijayawada, Krishna District, registered against respondents 4 and 5.
Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home produced written instructions stating that crime was investigated into and found to be false one, as such, the Investigating Officer who is 2nd respondent herein has forwarded the same to the Joint Commissioner of Police, Vijayawada referring the same as false and in turn, the Joint Commissioner issued proceedings dated 29.05.2018 by referring the same as 'false'. It is also submitted that after receipt of the said proceedings, though the 2nd respondent tried to contract the writ petitioner for serving the notice in the present crime, but he is unable to contact; and that the said notice was served on the writ petitioner on 04.07.2018. It is also stated that the 2nd respondent filed Final Report before the III Additional Chief Metropolitan Magistrate, Vijayawada on 04.07.2018 and the same was taken on file vide CFR No.3034/2018, dated 04.07.2018.
Recording the aforesaid submission of the learned Assistant Government Pleader, the writ petition is disposed of. However, it is open for the petitioner to avail alternate remedy as may be available to him under law. No order as to costs.
