SESHA SAI WRIT PETITION NO. 39343 OF 2012
O R D E R :
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"To declare the action of respondents 1 to 3 in interfering in civil disputes is illegal and without jurisdiction and consequently to direct the respondents 1 to 3 not to insist for selling out the petitioners land to the fourth and fifth respondents and to pass such other suitable orders as are necessary in the interest of justice."
2. When the matter is called, written instructions dated 29/12/2012 furnished by the Sub-Inspector of Police, Pahadisharif Police Station, Cyberabad Commissionerate have been placed on record by the learned Government Pleader for Home for the respondents.
3. The written instructions, reads as under: " It is respectfully submitted that the allegation of the petitioner that the fourth respondent approached this respondent to bring pressure upon them to sell their lands against their will and volition and that this respondent had been summoning them to the police station and threatening them with dire consequences if they failed to sell their lands to the fourth respondent in the course of time they even stopped going to the police station as and when this respondent sends message through the constables to come to the police station is absolutely false, baseless and hence the same is denied. The allegation of the petitioner that since they have not been approaching this respondent, this respondent with a team of constables have come to their lands by 5 p.m. on22/10/2012 threatened the labour who are working there in the field and demanded
to call them, upon being informed by their labour they went to their lands at that time the police were there with the active assistance of the fifth respondent and with his henchmen tried to remove the boundary stones and that this respondent further threatened by saying that they would be implicated in various criminal cases if they failed to accede to the demands of the fourth and fifth respondents is utterly false, baseless and hence the same is denied. The further allegation of the petitioner that this respondent had been sending the constables and interfering with their civil rights relating to the land is also false and hence the same is denied. It is submitted that the allegation of the petitioner that in the absence of any complaint, the respondent police are frequently visiting and threatening their labour to remove the boundary lines with the conspiracy of the fourth and fifth respondents to sell the lands to them and they are not in a position to face the high handed action of the respondents is also false and hence the same is denied.
It is respectfully submitted that as of now, no complaint whatsoever is received or registered against the petitioners herein on the file of Pahadisharif Police Station, Cyberabad. It is submitted that the dispute of the petitioners as well as the fourth and fifth respondents herein is purely civil in nature and hence this respondent has nothing to do with it. It is submitted that the petitioners unnecessarily involved the respondent police into their personal and civil disputes. It is submitted that at no point of time, this respondent sent any of the constables to summon the petitioners nor visited the subject lands of the petitioners. It is submitted that there is no necessity for this respondent to ask the petitioners to sell their lands to the fourth and fifth respondents herein. It appeared that due to wreck vengeance and personal grudge against the fourth and fifth respondent herein, the petitioners made baseless allegations against this respondent. Hence, the writ petition deserves no consideration."
