THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9821 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.575 of 2023 on the file of KPHB Police Station, Kukatpally, Cyberabad, registered for the offence under Section 8 (c) r/w. 20 (b) (ii) (B), 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The KPHB Police arrested this petitioner and others for being in possession of MDMA and other prohibited drugs. During investigation, other accused were also identified as consumers.

Quantity of contraband seized from this petitioner is 4gms. of MDMA. There are no other criminal cases pending against this petitioner according to the learned Additional Public Prosecutor.

Keeping in view that 4gms of MDMA drug is intermediary quantity and petitioner has no criminal antecedents, he can granted relief of regular bail, subject to following conditions:

i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of I Additional District & Sessions Judge-Cum-Metropolitan Sessions Judge, Medchal-Malkajgiri District.

ii) The petitioner/Accused No.3 after release shall appear before the concerned Station House Officer on every Monday and Wednesday for a period of eight weeks at 10.00 AM and thereafter as and when required, for the purpose of investigation. iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
