HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL REVISION PETITION No.3721 of 2015 ORDER:

Learned counsel for the petitioners seeks permission to withdraw the Civil Revision Petition.

Permission is granted.

Accordingly, the Civil Revision Petition is dismissed as withdrawn. However, it is made clear that this withdrawal will not prejudice rights of both parties much less the observations of the lower Court in the impugned order, to rely on any other evidence. As the Xerox copy of the document is not an instrument to impound with stamp duty and penalty within the meaning of Sections 2(14) and 33 of the Indian Stamp Act, for a copy of document cannot be impounded by exercising the power under Section 33 of the Act and as collateral purpose is unknown under the Stamp Act, but for to admit for collateral purpose under Section 149 of the Indian Registration Act, if it is duly stamped; other than relying on the document, the petitioners are entitled to rely on any other evidence. No order as to costs. 4.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
