THE HONOURABLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.69 OF 2017

O R D E R

This contempt case was instituted alleging willful disobedience to the interim order dated 03.02.2016 passed in W.P.M.P.No.776 of 2016 in W.P.No.624 of 2016. By the said order, the Station House Officer, Gangadhara Police Station, Gangadhara Village and Mandal, Karimnagar District, was directed to act strictly in accordance with the directions of the Supreme Court in LALI TA KUMARI V/ s. GOVERNMENT OF UTTAR PRADESH1 in so far as the complaint dated 20.07.2015 was concerned.

The allegation of the petitioners was that despite the aforestated order, the Station House Officer did not take any action. While so, N.Swaroop Raj, the Sub-Inspector of Police, Gangadhara Police Station, filed a counter-affidavit on 03.03.2017, wherein he stated that after assuming charge as such on 25.08.2016, he failed to notice the complaint of the petitioners and passing of the interim order by this Court. He thereafter traced out the complaint dated 20.07.2015 upon filing of this contempt case and registered Crime No.37 of 2017 under Sections 447, 427 read with 34 IPC and Crime No.38 of 2017 under Sections 143, 447, 427, 506 read with Section 149 IPC and took up investigation.

In the light of the aforestated development, this Court finds no evidence of any willful disobedience though there appears to be some delay on the part of the respondent in complying with the interim order.
