HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9722 of 2014 ORDER :

This criminal petition is filed by the petitioners/accused under Section 482 Cr.P.C to quash the proceedings in CFR No.4820 of 2009 on the file of Judicial Magistrate of the First Class for Special Mobile Court, Guntur District including Crime No.181 of 2009 of Nagarampalem, Guntur District registered for the offences punishable under Sections 323, 406, 419, 420, 468, 471, 506 read with 34 I.P.C.

2) It is represented by the learned Public Prosecutor that the prosecution agency filed a final referred report after investigation and the petition since filed against the F.I.R no way survives and as such the petition becomes infructuous.

3) In the result, the petition is dismissed as infructuous. If the defacto-complainant, if files any protest petition, the further remedy, if any, is left open to the petitioner.

4) Miscellaneous petitions, if any pending, shall stand closed.
