ORDER

This petition under Section 407 Cr.P.C., is filed by the petitioner/accused seeking to transfer C.C.No.575 of 2013 on the file of Additional Judicial First Class Magistrate, Gudivada to the Court of Judicial First Class Magistrate, Nalgonda.

2. The second respondent herein filed the aforesaid case against the petitioner/accused for the offence punishable u/s.138 of Negotiable Instruments Act, 1881. Petitioner states that as the other cases filed against her are pending before the Court at Nalgonda, she seeks to transfer the said C.C. to the Court of Judicial First Class Magistrate, Nalgonda.

Since the ground on which the petitioner seeks to transfer the aforesaid case is not at all appreciable and the said CC is also pending for trial, this Court is not inclined to transfer the said case. However, the presence of the petitioner/accused before the trial Court is dispensed with except on the dates whenever her presence is insisted by the trial Court and she shall be represented by her counsel on all hearing dates.

With the above direction, the Transfer Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
