THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 10253 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "for the reasons stated in the accompanying affidavit the petitioner pays that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of 3rd respondent in insisting the petitioner to appear before his authority and to yield and settle to the terms of 4th respondent for payment of money, as illegal, irregular, irrational, without any authority of law and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents not to interfere in any manner with the petitioner's personal life and liberty and pass such other orders or order as this Hon'ble Court may deem fit and proper in the circumstances of the case."

The Inspector of Police, Saroornagar Police Station, Cyberabad, furnished written instructions dated 13.04.2016 to the office of the learned Government Pleader for Home. Therein, he stated that no complaint had been received against the petitioner and therefore the question of summoning him to the police station did not arise.

He further denied the allegation of the petitioner that the police authorities were calling him through certain mobile numbers to appear before them and pressurizing him to settle his civil disputes with the fourth respondent. The Inspector further stated that no officer was working in the police station with the cell phone No.9491039107 and therefore, calling the petitioner over the said cell phone by the police authorities did not arise. The Inspector concluded by stating that the police had never insisted upon the petitioner paying any money to the fourth respondent or summoned him in that regard.

The afore-stated stand of the police authorities is duly

taken on record. In the light thereof, no adjudication is warranted on merits in this writ petition.

4. Sri Ambati Srinivas, learned counsel representing Sri Namavarapu Chanti Babu, learned counsel for the petitioner, is also agreeable to the closure of the writ petition recording the stand of the police authorities.

Recording the afore-stated stand of the police authorities, the Writ Petition is closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
