HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22002 OF 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the 4th respondent in interfering with the digging activities of the petitioner in respect of the lands to an extent of Ac.58.16 cents in R.S.Nos.180, 181, 189, 200, 201, 202, 203, 204, 205, 206, 215, 216, 217 at Pamulapadu Village, Pedaparupudi Mandal, Krishna District, as illegal and arbitrary and for a consequential direction to the 4th respondent not to interfere with the petitioner's aquaculture activities.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Fisheries produced written instructions dated 05.07.2016, wherein it is stated that on the application of the petitioner, the District Level Committee has granted provisional permission to the petitioner to dig the fish tanks in the aforesaid survey numbers vide Registration No.PRF011500001671, dated 11.05.2016 and that it is ascertained from the revenue department that they have insisted for payment of fee for peg marking in the shape of challan and the petitioner has paid the amount and the Mandal Revenue Authority has given peg marking on 03.07.2016 and allowed to dig the fish tank.

Recording the aforesaid submissions made by the learned Assistant Government Pleader for Fisheries, this writ petition is disposed of. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
