CVNR, J & TA, J Dt: 26.11.2018 Judgment: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Family Court Appeal (FCA) is filed by the respondenthusband in FCOP.No.464 of 2017 on the file of the Judge, Family Court, City Civil Court at Secunderabad, feeling aggrieved by Order and Decree, dated 19-01-2018, passed therein whereby the FCOP was partly allowed by dissolving the marriage between the parties and directing the appellant to pay a sum of Rs.12 lakhs towards permanent alimony to the respondent.
At the hearing, both the parties are personally present. The respondent informed the Court that in pursuance of the settlement reached between herself and the appellant, the latter agreed not to pursue the Appeal, if the respondent deposits a sum of Rs.8 lakhs towards full and final settlement of all her claims and that in pursuance of the said understanding, she has received Rs.8 lakhs instead of Rs.12 lakhs as awarded by the Court below towards permanent alimony. She has also informed the Court that she agreed to withdraw CC.No.418 of 2015 on the file of the XV Additional Chief Metropolitan Magistrate, Hyderabad, and MC.No.55 of 2018 on the file of the Family Court, Secunderabad. The appellant confirmed the above-mentioned facts stated by the respondent and requested that the Appeal be disposed of confirming the order of the lower Court to the extent of
CVNR, J & TA, J Dt: 26.11.2018 dissolution of marriage subject to the understanding reached between them as recorded above.
In the light of the facts stated above, the FCA is disposed of, without adjudicating the same on merits and by placing on record, the terms of understanding between the parties as recorded above.
