This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri P. Vishnuvardhana Reddy, Advocate for the Petitioner and the public prosecutor on behalf of the Sole Respondent.

This petition is filed under Section 438 of Cr.P.C. seeking bail to petitioner/accused No. i in the event of his arrest in connection with I Crime No.79 of 2021 of Bheemaram Police Station, Mancherial District, registered for the offences punishable under Sections 504. 505(lXb) and 595(2) ofthe Indian Penal Code.

Heard Mr.P.Vishnuvardhana Reddy, learned counsel for the petitioner, and leamed Assistant Public Prosecutor tbr the respondentState. 3.

Learned counsel for the petitioner submits that petitioner was issued notice under Section 41-A Cr.P.C.. However, he is apprehending that he may be arrested by the police whenever he appears before the Court concerned, 4.

On the other land, leamed Assistant Public Prosecutor submits that the police are following the procedure as contemplated under Section 4l-A CI.P.C. and also the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihart . 5.

As already police issued notice under Section 41-A ol Cr.P,C., they shall follow the procedure laid down under Section 4l-A of Cr.P.C. and also the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar (supra) scrupulously. It is needless to say, any deviation in this regard will be viewed seriously.
