HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25939 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " .......to issue writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent in not sanctioning medical leave to the petitioner from 02/ 03/ 2019 to 15/ 03/ 2019 as illegal, arbitrary, unjust, unreasonable and contrary to Art.14 of the Constitution of India and consequently direct the respondents to sanction medical leave to the petitioner from 02/ 03/ 2019 to 15/ 03/ 2019 duly considering the representations of the petitioner dated 02/ 03/ 2019, 16/ 03/ 2019 and 22/ 08/ 2019 with all consequential benefits......."

Heard Sri D.Ramakrishna, learned counsel for the petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that she is working as a Multipurpose Health Assistant with the respondents and she had applied for medical leave from 02.03.2019 to 15.03.2019 owing to illhealth. As the respondents were not sanctioning the said medical leave, the petitioner has submitted representations to the respondents on 02.03.2019, 16.03.2019 and 22.08.2019 requesting to sanction medical leave from 02.03.2019 to 15.03.2019, but the respondents have not passed any orders on the said representations nor sanctioned medical leave from 02.03.2019 to 15.03.2019.

Learned counsel for the petitioner contended that appropriate orders be passed in the writ petition directing the

respondents to consider the representations submitted by the petitioner on 02.03.2019, 16.03.2019 and 22.08.2019 and pass appropriate orders in accordance with law.

Learned Government Pleader appearing for respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed in accordance with law on the representations submitted by the petitioner.

This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioner on 02.03.2019, 16.03.2019 and 22.08.2019 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. With the above directions, the writ petition is disposed of. No order as to costs.
