THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8034 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare inaction of the respondents in not rectifying the date of birth and age of the petitioner in service records, as per his school leaving Transfer certificate dated 12-07-1985, i.e. 10-08-1966 and 21 years as on 02-09-1987; as illegal, arbitrary and violative of articles 14, 16 and 21 of the Constitution of India read with National Coal Wage Agreement-III and Implementation Instructions No.76 dated 25-04-1988 and consequently direct the respondents to rectify the date of birth and age of the petitioner in his service records as per his School Leaving Transfer Certificate dated 12-07-1985, i.e. 10-08-1966 and 21 years as on 02-091987, in the interest of justice."
Heard, Sri Surendra Desai, learned counsel for the petitioner and Sri J. Srinivasa Rao, learned Sanding Counsel for respondents.
When the matter is called, it is represented by learned counsel for the petitioner so also the learned Standing Counsel for respondents that the issue in the present writ petition is squarely covered by the common order of this Court in W.P.No.33343 of 2012 and batch, dated 31-03-2015 and copy of the same is also placed on record along with the writ petition as material paper. Following the above said common order and for the reasons recorded therein, this writ petition is also disposed of in terms of
the above order.
Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. There shall be no order as to costs.
