HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.7583 of 2019 ORDER :
This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, by the petitioners-A1 and A2 seeking to quash the proceedings in C.C.No.928 of 2017 on the file of the XVII Addl. Chief Metropolitan Magistrate, Hyderabad, which was taken cognizance of the offences punishable under Sections 406, 420 and 506 IPC. 2.
Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor representing the State.

The contention of the learned counsel for the petitioners is that the petitioners are innocent of the offences alleged against them and they have been falsely implicated with a view to harass them. He further submits that the allegations made in the F.I.R. do not make out any case for the offences punishable under Sections 406, 420 and 506 IPC and the police without proper investigation, submitted the charge sheet and hence, the proceedings in the above C.C. are liable to be quashed.

The truth or otherwise of the allegations made in the F.I.R. can only be decided during the course of trial. This Court is not supposed to make roving enquiry against the petitioners on the allegations made in the charge sheet. Hence, this Court does not find any grounds to quash the
proceedings in C.C.No.928 of 2017 on the file of the XVII Addl. Chief Metropolitan Magistrate, Hyderabad. 5.
Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
