HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6858 OF 2018 ORDER:

A perusal of the Schedule-I of Cr.P.C. clearly shows none of the offences punishable under Sections 354-D, 509 and 506 Part-1 R/w.34 of I.P.C. are non bailable. Thus, in a bailable offence, the application under Section 438 of Cr.P.C. for anticipatory bail is not maintainable. Thereby, the Petition is disposed of as remedy of the petitioners is to appear before the learned Magistrate concerned with an oral request to grant bail in bailable offences to avail the right contemplated by Section 438 Cr.P.C. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
