THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO C.E.R.C.No.6 OF 2005 AND C.E.A.No.8 OF 2005 P.C: (per the Hon'ble Sri Justice Dilip B.Bhosale) Learned counsel for the Revenue submits that in view of the judgment of the Bombay High Court in Commissioner of Customs v. Standard Industries Limited[1], he has instructions to withdraw the Reference and the Revenue's Appeal, as not maintainable, with liberty to the Revenue to file appeal before the Supreme Court. The Reference and the Appeal are accordingly disposed of as withdrawn. It is open to the Revenue to file appeal, if they so desire and advised, before the Supreme Court. All contentions on merits are left open.

Miscellaneous petitions, if any, filed in the Reference and Appeal stand disposed of.
