THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.2556 OF 2009 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue a writ, order or direction more particularly a writ in the nature of Writ of Mandamus declaring the action of the 3rd respondent in issuing proceedings in D.Dis.No.(H3)/3364/2008, dated 23-12-2008, wherein directing the 4th respondent to send proposals for re-naming the Indoor Stadium of Yemmiganur Town, Kurnool District from "NTR Indoor Stadium" to "Sri Padmasri Machani Somappa Indoor Stadium", as illegal, arbitrary unconstitutional malafide, un-ethical and against the public policy and consequential resolution passed by the 4th respondent Municipality vide its Resolution in Rc.No.159, dated 31-01-2009 as illegal, arbitrary and unethical and direct the respondents to continue the name of Indoor Stadium of Yemmiganur Town, Kurnool District as "NTR Indoor Stadium."

When the matter is taken up for hearing, learned Standing Counsel appearing for respondent Nos.4 and 5 produced written instructions of the Commissioner, Yemmiganur Municipality, Yemmiganur wherein it is held as under:

"With reference to the subject above cited, I submit that Council Resolution No.72, dt:30.08.2006 passed by Yemmiganur Municipal Council has been cancelled by District Collector and District Magistrate through Rc.H3.336/2006, dt:06.03.2006 to name the Municipal Yemmiganur Indoor Stadium as Padmasree Machani Somappa Indoor Stadium, which is being called as NTR Indoor Stadium under the powers vested to him under section of Municipalities Act, 1965.

Further I submit that this office has no objection to call the name as NTR Indoor Stadium mentioned in the tender by Engineer-in-Chief (P.H.) in the name of Nandamuri Taraka Ramarao (NTR), the former Hon'ble Chief Minister of Andhra Pradesh until Government orders received if any in this matter."

From a perusal of the above written instructions, it is evident that nothing survives for adjudication in this writ petition. 4.

Accordingly, this Writ Petition is disposed of as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
