THE HON'BLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION NO.10458 OF 2025 ORDER:

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS') by the petitioner/accused seeking regular bail in connection with FIR No.327 of 2025 of Armoor Police Station, Nizamabad District. The offences alleged against the petitioner are under Sections 74, 75(2), 78, 79, 351(3) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the complainant lodged a report before police on 05.07.2025 stating that the petitioner herein harassed her by messaging to her mobile phone, following her without her willing, talking with her and sexually harassed her and also used to harass by making gestures towards her. It is also stated that the petitioner threatened her saying that he would morph her photos and post her nude photos on social media and also threatened to kill her husband if the matter is disclosed to him. As such, requested the police to take necessary action against the petitioner. Basing on the

said complaint, the police registered the case against the petitioner for the above offences.

Heard Ms.N.T.Lavanya, learned counsel for the petitioner, and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent-State.

The contention of learned counsel for the petitioner is that petitioner is an innocent person and the offences alleged are below seven years. Petitioner is in jail from 15.07.2025 i.e., more than one month and that material part of investigation is also completed. As such, prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the alleged offences are serious in nature and nine witnesses were already examined. As such, requested the Court to dismiss this petition. 6.

Considering the submissions made by the respective counsel and the material placed on record, admittedly, the petitioner is in jail from 15.07.2025 and as seen from the remand report nine witnesses were examined. However, considering the period of incarceration of petitioner in jail this

Court deems it appropriate to grant bail to the petitioner subject to the following conditions:

i.

The petitioner/accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Judicial Magistrate of First Class at Armoor.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the other conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, pending, if any, shall stand closed.
