THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.10477 of 2025 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused No.9 in Crime No.246 of 2024 of Charminar Police Station, Hyderabad, on pre-arrest bail, the present Criminal Petition is filed.

The brief facts of the case are that on 05.12.2024 a complaint was received from Sri Mohammed Moinuddin stating that he and his brother, Mohammed Mateenuddin, had been running a cloth and saree business under the name "Fashion Readymade Garments"

at Sunitha Textile Lane, Madina, Hyderabad. On the same day at around 17:15 hours, while a customer was purchasing items in their shop, one Mohammed Moin @ Shera, owner of MS Sarees located beside their shop, along with his worker, called the customer and tried to divert them to their shop. When questioned, Shera allegedly argued, abused the complainant in filthy language, and threatened him with dire consequences. Immediately thereafter, Shera, along with Jaffar, Moula, Ali, Shahbaz, Shahed, Siddiq, Samdani, and others, trespassed into the shop of the complainant and assaulted him

and his brother with hands and steel pipes, causing injuries. The complainant sustained bleeding injuries to his chest, right leg, and above the right eye, while his brother suffered injuries to his jaw and cheek. The accused also damaged shop property, including the counter, mannequins, and displays.

Heard Sri Syed Esa Faraz Mehdi, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the allegations leveled against the petitioner are vague and baseless, and that the petitioner is innocent of the offences alleged in the complaint. He further submitted that, due to a grudge, the de facto complainant pressurised the police to implead the petitioner. Therefore, he prayed that the Court grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that as on today 17 witnesses were examined and the main allegations are against accused Nos.1 to 8. Therefore, he prayed the Court to pass appropriate orders.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that the petitioner is arrayed as accused No.9. As seen from the remand report, there are no specific allegations against the petitioner. Further, 17 witnesses have been examined and the material part of the investigation has been completed. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Charminar Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 A.M., and 05:00

P.M., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
