HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22645 OF 2018 O R D E R :

The grievance of the petitioner is that the respondent police are interfering with the civil dispute between the petitioner and third parties.

Learned Assistant Government Pleader for Home produced written instructions stating that a complaint was received on 24.04.2018 from one Chanderjit Reddy against one Sanobar Baig and others stating that they are trespassing into his land and the same was also entered into the General Diary and enquiry was also conducted. Similarly on 21.05.2018, similar allegations were made against that Sanobar Baig by one P.Vikas, and a GD entry was also made; and that during the course of enquiry it was found that the petitioner has purchased the land which is in dispute since long time; that since there is civil dispute between the petitioner and his opponent party, the police could not take action on the complaint of the petitioner. It is also stated that when the petitioner requested for providing police protection to take possession of the property, he was advised to get orders from the Civil Court for police protection. The other allegations made against respondent police are denied.

In the written instructions produced by the learned Assistant Government Pleader it is stated that complaint of the Vikas was enquired into and found to be civil in nature.

Recording the aforesaid submissions of the learned Assistant Government Pleader, the writ petition is disposed of. However, the respondent police shall not interfere with the civil disputes pending between petitioner and third parties. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
