THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.25940 of 2019 ORDER:

Challenge in this writ petition is to the action of the third respondent in not taking steps to register a case based on the complaint of the petitioner, dated 08.11.2019.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 25.11.2019, submits that the complaint of the petitioner, dated 08.11.2019, has not been received by the third respondent. However, when the third respondent tried to secure the presence of the petitioner at the given address, the petitioner was not available. Learned AGP further submits that whenever the petitioner approaches the third respondent along with the complaint, necessary action would be taken. A copy of the aforestated written instructions is placed on record.

Having regard to the submissions made on behalf of the third respondent, this Court is of the view that no further orders are required to be passed in the writ petition, except directing the petitioner to approach the concerned authorities, who shall take the complaint of the petitioner and enquire into the matter.

The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
