THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9386 OF 2023 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in C.O.R.No. 22 of 2022 pending on the file of Station House Officer, Quthbullapur Police Station, registered for the offences punishable under Sections 8(C) read with 21(b) of NDPS Act-1985 and under Sections 8(C) read with 22(b) of NDPS Act-1985. 2.

Heard learned counsel for the petitioner/Accused No.3 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

On 16.02.2022 Quthbullapur Police apprehended Accused Nos.1 and 2 and found (9.301) grams of Cocaine, (2.458) grams of Cocaine and also one Brown color crystal packet MDMA drug (1.002) grams.

Learned Additional Public Prosecutor on instructions would submit that Accused Nos.1 and 2 already released on bail. Keeping in view the other accused are already released there are no reasons to arrest apprehend this petitioner.

Keeping in view, on the basis of the confession of Accused Nos.1 and 2, this petitioner was arrested on 21.04.2023, this Court deems it appropriate to enlarge the petitioner on bail subject to the following conditions: i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of learned I Additional District and Sessions Judgecum-Metropolitan Sessions Judge MedchalMalkajgiri District at Malkajgiri.

ii) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
