THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.P.M.P.No.3089 of 2016 & CRIMINAL PETITION No.2565 of 2016 ORDER:
This petition is filed by A.1 to A.3 under Section 482 of Cr.P.C. seeking to quash the proceedings in C.C.No.715 of 2015 pending on the file of II AJCJ-cum-XIX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad for the offence under Section 498-A IPC and Sections 3 & 4 of Dowry Prohibition Act.
When the matter is taken up for hearing, both the counsel filed Crl.P.M.P.No.3089 of 2016 stating that the parties have entered into compromise and therefore, they prayed to allow the petition and to quash the impugned proceedings.
Both the parties as well as their counsel have signed on the joint memo of compromise annexed to Crl.P.M.P.No.3089 of 2016. The parties, who are present in the Court, also affirmed the same. A perusal of the affidavit filed in support of the petition goes to show that the matter was settled between the parties.
In view of the amicable settlement of the dispute between the parties and in view of the nature of the proceedings, Crl.P.M.P.No.3089 of 2016 is ordered and the compromise is recorded. Consequent thereto, the Criminal Petition is allowed and the proceedings in C.C.No.715 of 2015 pending on the file of II AJCJ-cum-XIX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad are hereby quashed as against the petitioners herein. It is directed that this compromise shall form part of the record. The petitionersA.1 to A.3 are directed to pay a sum of Rs.5,000/- each, towards costs to the Telangana Legal Services Authority, Hyderabad on or before 21st March, 2016.
