THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9347 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused No.1 seeking anticipatory bail in the event of her arrest in connection with Crime.No.319 of 2023 on the file of P.S.Kazipet Police Station, Warangal, registered for the offences punishable under Sections 420, 306 r/w 34 of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The deceased, who is also working along with the petitioner in the railway department committed suicide alleging that this petitioner and another are responsible for death.

It is the case of the police that earlier complaint was filed by this petitioner, alleging sexual harassment by the deceased at work place.

On 30.01.2023, the deceased was found to have committed such harassment and accordingly, he was transferred and also demoted.

As seen from the complaint, except stating that this petitioner was responsible for the death of deceased on account of the events that transpired at the work place, there are no instances that would amount to instigating to commit suicide.

Keeping in view, that the petitioner had earlier filed a complaint against the deceased for sexual harassment and also after enquiry it was found that the deceased and in fact committed such acts, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner, subject to the following conditions:

1) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Kazipet Police Station, Warangal, on 03.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on her executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to her satisfaction.

2) On such release, petitioner/Accused No.1 shall appear before the concerned Station House Officer, as and when required.

3) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
