HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CIVIL MISCELLANEOUS APPEAL No.4803 of 2004 JUDGMENT : (per Hon'ble Sri Justice R.Subhash Reddy) This appeal, under Section 28 of the Hindu Marriage Act, 1955 (for brevity "the Act") is filed by the appellanthusband aggrieved by the order and decree dated 29.09.2004 in O.P.No.18 of 2003 passed by the Senior Civil Judge, Chirala, Prakasam District, allowing the petition filed by the respondent-wife under Section 9 of the Act, seeking restitution of conjugal rights.
2. Though the appeal is of the year 2004, when the matter is called, there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter.
