THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.32753 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the 3rd respondent in disqualifying the petitioner from tender notification No.

13/AE1/SSBM (G)/2015-16 dated 21-08-2015 is wholly illegal, arbitrary and without any basis."

Heard Sri I.V. Radhakrishna Murthy, learned counsel for the petitioner and learned Government Pleader for Industries and Commerce for respondents, apart from perusing the material available before this Court. During the course of hearing it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation, dated 01-10-2015 to the respondents 1 and 3 and no orders have been passed on the said representation and necessary directions may be issued to the respondents 1 and 3 to take appropriate action on the said representation by fixing some time frame.

In view of the above submissions, without expressing any opinion on the merits, the writ petition is disposed of, directing the respondents 1 and 3 to take appropriate action on the representation, dated 01-10-2015 said to have been submitted by the petitioner herein, within a period of two (2) weeks from the date of receipt of a copy of this order, in accordance with law, after giving notice and opportunity of being heard to the petitioner herein. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. There shall be no order as to costs. ___________________ A.V.
