THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13083 OF 2015 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.9 of 2015 on the file of the Principal Special Judge for CBI Cases, Nampally at Hyderabad. arising out of offences under Sections 7, 12 and 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act.

Heard and perused the material available on record. After arguing for sometime, the learned counsel for the petitioner confined his arguments with regard to dispensing with the presence of the petitioner before the Court below. Learned counsel for CBI vehemently opposed dispensing with the presence of the petitioner before the Court below. Considering the facts and circumstances of the case and as the question of identity of the petitioner does not arise, the presence of the petitioner before the trial Court is dispensed with except on the dates when the trial Court insists for his appearance. The petitioner is directed to be represented by his counsel before the Court below on all hearing dates.
