THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3447 of 2017 ORDER:

An order of suspension passed by the Revenue Divisional Officer vide proceedings Rc.No.C3/10524/2016, dated 20-01-2017 is under challenge in the present writ petition.

Followed by a show cause notice and submission of explanation offered by the petitioner, the Revenue Divisional Officer, Khammam vide proceedings Rc.No.C3/10524/2016, dated 20-01-2017 passed an order of suspension of fair price shop authorization of the petitioner, pending enquiry. According to the learned counsel for the petitioner, the said order of suspension is un-warranted and illegal and the allegations made against the petitioner are un-sustainable and incorrect.

On the other hand, it is submitted by learned Government Pleader appearing for the respondents that the petitioner herein has already filed a statutory appeal before the Joint Collector on 27-01-2017 and the same is pending before the Joint Collector.

It is submitted by learned counsel for the petitioner that the stay application has also been filed along with the said appeal.

Since the petitioner herein has already availed the alternative remedy of appeal before the Joint Collector, Khammam on 27-01-2017 and the same is admittedly pending consideration before the Joint Collector, this Court deems it appropriate to direct the Joint Collector to pass appropriate orders on the stay application said to have been filed by the petitioner herein within a timeframe. For the aforesaid reasons, the writ petition is disposed of, directing the Joint Collector, Khammam to pass orders on the stay application, dated 27-01-2017 said to have been filed by the petitioner herein along with the appeal, within a period of two (2) weeks from the date of receipt of a copy of this order. Joint Collector shall also made an endeavour to dispose of the main appeal, as expeditiously as possible. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
