HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.16704 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondents in disturbing the nature of the land of the petitioners in Sy.No.123, 127, 402, 404, 405, 406 admeasuring 62 acres 21 guntas in Vangapalli Revenue Village of Yadagiri Gutta Revenue Mandal of Bongiri Yadadri District as illegal and arbitrary. Heard the learned counsel for the petitioners and the learned Government Pleader for Irrigation and Command Area Development(Telangana) for respondents.

The learned Government Pleader on instructions submitted that no work was taken up in the tank bed portion of patta lands existing in Sy.Nos.123, 127, 404, 402, 405 & 406. The work will be taken up for improvements to existing bund, existing sluice and existing weir portion only. The learned Government Pleader also filed written instructions issued by the second respondent in that regard.

In view of the submissions made by the learned Government Pleader and the written instructions issued by the second respondent, the writ petition is disposed of.

Consequently, miscellaneous petitions pending if any in this writ petition shall stand closed.
