THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.10478 of 2025 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused No.7 in Crime No.326 of 2023 of Nampally Police Station, Hyderabad, on pre-arrest bail, the present Criminal Petition is filed.

The brief facts of the case are that on 01.11.2023 de facto complainant-M/s. Shri Vybhavi Chit Funds (India) Private Limited lodged a report before the Police stating that the petitioner along with other accused forged the signature and executed the registered deed.

Heard Sri M.V. Subba Reddy, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent and is no way connected to the alleged offences and that, and he is only purchaser of the subject property and he was also served with a notice under Section 41-A of the

Cr.P.C on 04.08.2025, and in spite of the same he was shown as absconding in the remand report. Therefore, prayed this Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor submits that the petitioner was served with notice under Section 41-A of Cr.P.C on 15.07.2025 and 04.08.2025, and in spite of the same, the petitioner herein is not co-operating with the investigation. At this stage, granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that the petitioner was arrayed as accused No.7 in the subject crime. The allegations against the petitioner are that the petitioner purchased the property under the registered sale deed on 12.03.2021, which the complainant claimed as fraudulent. Further, as seen from the record, it appears that the petitioner was served with notice under Section 41-A of the Cr.P.C and also given specimen signature. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Nampally Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 A.M., and 05:00 P.M., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
