HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.7053 of 2018 ORDER:

This petition is filed under Section 482 of Cr.P.C. by the petitioner/accused seeking to quash the proceedings against him in S.C.No.40 of 2018 on the file of Principal Assistant Sessions Judge, Tirupati which was taken cognizance under sections 376 r/w 511 IPC.

Heard.

Having regard to the fact that charge sheet is filed and case is registered and coming up for framing charges, this court is not inclined to quash the proceedings at this stage. Therefore, while dismissing the Criminal Petition, a liberty is given to petitioner/accused to file a petition before the trial Court seeking discharge taking pleas that are permissible to him under law, in which case the trial Court shall pass appropriate orders on merits at the earliest.

As a sequel there to, miscellaneous petitions, pending if any, shall stand closed.
