THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.33092 of 2016 ORDER:

Heard Mr.A.Ravinder Reddy for petitioners, the Assistant Government Pleader for Revenue for respondents 1 to 3 and Mr.S.S.Varma for the 4th respondent.

The petitioners pray for Mandamus declaring the action of the respondents in acquiring the plots of petitioners in R.S.No.523/ 2 of Mummidivaram Village and Mandal, East Godavari District, for widening/ Two laning of NH 214 (New NH

216) without fixing compensation as per the prevailing market value and paying the same, laying the road, as illegal and unconstitutional.

Admittedly, as on date, the 3rd respondent is yet to pass award under the National Highways Act, 1956. According to the Assistant Government Pleader, the details of valuations are being collected and award will be passed in accordance with law. Mr.Varma appearing for 4th respondent makes a statement that unless compensation is determined and paid to the petitioners or for that matter, persons from whom the land is acquired, possession will not be taken.

His statement is placed on record.

The 3rd respondent is directed to determine the compensation payable to the petitioners and communicate the same to the 4th respondent within eight weeks from the date of receipt of a copy of this order. Till compensation is determined and paid, the possession of petitioners shall not be disturbed. The writ petition is accordingly disposed of. No order as to costs.
