ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A13 seeking to quash the proceedings in C.C.No.63 of 2015 on the file of Judicial First Class Magistrate, Kanigiri, for the offences punishable under Sections 143, 427, 323 r/w 149 IPC, against them.

2. It is alleged in the charge sheet that on 19.01.2015 at 0200 hours, A1 to A13 came with JCBs and proclainers, operated their machinery and damaged the way, which is using by the farmers of Kudumulakuntla village to go to their fields, and also removed some palmyra trees. When the villagers tried to avoid the acts of the accused, they abused them in filthy language and thrown them with hands. On the complaint, a case in Cr.No.3 of 2015 u/s.143,323,447 r/w.149 IPC was registered against the accused.

3. Heard and perused the material on record.

4. As per the charge sheet, there are certain allegations against the petitioners. In view of the same, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings. However, the petitioners/A1 to A13 are at liberty to file a discharge application before the trial Court in accordance with law.

5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
