THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.13347 of 2017 ORDER:

The petitioner prays for mandamus declaring the action of Respondent No.3 in not registering the Complaint dt. 11.01.2017 against Respondent Nos. 5 and 6 as illegal and unconstitutional. The petitioner filed the instant Writ petition on the premise that the complaint is sent and it is received by respondent No.3 and no action is taken.

The learned Assistant Government Pleader referring to Written Instructions of Respondent No.3 dt. 20.04.2017, submits that the cover sent by the petitioner was received and the cover did not contain the Complaint dt. 11.01.2017 and the petitioner is also not available and hence, the complaint could not be registered. The learned Assistant Government Pleader further states that if the complaint is given, respondent No.3 is prepared to investigate and do the needful.

Statement of Respondent No.3 is placed on record. The Writ Petition is disposed of by this Order: (a) The petitioner is given liberty to personally present the copy of this Order and also the complaint dt. 11.01.2017 within 10 days from today.

(b) The respondent No.3, as stated through his Written Instructions dt.

20.04.2017, examines the Complaint, makes a GD entry and proceeds in accordance with law.

Miscellaneous petitions, if any, pending in this case shall stand disposed of.
