HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE MRS JUSTICE ANIS Writ Petition No.24647 of 2016 Order: (per V.Ramasubramanian, J.) The petitioners have come up with the above writ petition challenging the Affiliation procedure and Regulations of the year 2016 issued by the Jawaharlal Nehru Technological University, and for a consequential declaration that the disaffiliation of some of the courses governed by the petitioner-institution for the current academic year are illegal.
2. After ordering notice in the writ petition and after hearing the learned counsel for the University, we passed an interim order on 28-7-2016, which reads as follows: "Out of several courses for which affiliation has been rejected by the University for the current academic year, we are on the considered view, on the basis of the chart produced by the University that the petitioners can have the benefit of doubt only insofar as four undergraduate courses are concerned. They are 1) B. Tech CSE 2) B. Tech ECE 3) B. Tech EEE 4) B.Tech Electronics and Computer Engineering. This is due to the fact that in two out of these four cases, there is no deficiency in faculty though some deficiencies are pointed out in laboratory.
In the other two cases, the deficiency in faculty is pointed out to be 1 out of 24 or 1 out of 12.
Therefore for the present, an interim order issued directing the University to include the petitioner-college for counselling, only in respect of these four courses B. Tech CSE, B. Tech ECE, B.Tech EEE and B. Tech Electronics and Computer Engineering. The petitioner-college shall either prove that there are no deficiencies with respect to the laboratory or at least make good the deficiency within two weeks. This interim order is subject to final outcome. Students shall be notified accordingly. Since the last date for counselling is fixed as today, viz., 28.07.2016 and since this interim arrangement is directed today, the Convenor shall extend the counselling by one day, viz., tomorrow 29.07.2016. The counsel appearing for the University shall take the responsibility of informing the same to the Convenor."
3. Pursuant to the aforesaid order, the University has granted provisional affiliation, in respect of four courses namely B.
Tech CSE, B. Tech ECE, B. Tech EEE and B. Tech Electronics and Computer Engineering to the petitioner/ college. The petitioner/college was also included in the counselling, in respect of these courses. The counselling is now over.
4. Therefore at this stage, the question of considering the issue relating to affiliation to other courses, does not arise, as counselling is already over and admissions have gone on.
5. Therefore, the writ petition is closed with a direction to the University to confirm the affiliation granted to the courses indicated above, pursuant to the interim order, for the academic year 2016-17. In respect of the remaining courses, it is open to the petitioner/college to rectify the deficiencies, satisfy the University and seek affiliation for the next academic year. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
