HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY CIVIL REVISION PETITION No.5150 of 2017 Date:06.10.2017 Between:

Macherla Padmavathi, W/o Late Venkata Rathnam ..... Petitioner And:

Kattamuri Munikanya, W/o Venkateswarlu .....Respondent Counsel for the petitioner: Mr. G.L.Nageswar Rao The Court made the following:

CVNR, J CRP.No.5150 of 2017 Dated:06.10.2017 ORDER:

This Civil Revision Petition is filed against order, dated 31.01.2017, in I.A.No.142 of 2006 in O.S.No.100 of 2003 on the file of the learned Principal District and Sessions Judge, Visakhapatnam, whereby it has knocked down the bid in favour of the decree-holder for a sum of Rs.58 lakhs by declaring her as the highest bidder.

The only ground urged by Mr. G.L.Nageswar Rao, learned counsel for the petitioner, before this Court is that though the property was valued as far back as the year 2011, the same was not revised though the sale proclamation was made in the year 2016 and that the property was sold for a low price without revising its value.

Admittedly, when the sale proclamation was made in the year 2016, the petitioner failed to submit her objections to the valuation. Therefore, having failed to object to the valuation shown in the sale proclamation, the petitioner cannot be permitted to raise objection regarding the valuation of the property at a later stage. Hence, on this ground alone, the Civil Revision Petition is dismissed.

CVNR, J CRP.No.5150 of 2017 Dated:06.10.2017 As a sequel, CRPMP.No.6691 of 2017 stands dismissed as infructuous.
