THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.5789 of 2017 ORDER:

This Writ Petition is filed for the following relief: "For the above aforesaid reasons that this Hon'ble Court may be pleased to issue a writ or one in the nature of Mandamus or an appropriate Writ or Order or direction to the Respondents herein holding that the inaction on the part of the Respondents for not paying exgratia as per S.O.O (CGM-HRD) Rt.No.761 dated 26.10.2013 even after lapse of two years (about) is illegal, arbitrary and violation of fundamental rights guaranteed under the Constitution and direct the Respondent to pay Exgratia to petitioner as per S.O.O (CGM-HRD) Rt.No.761 dated 26.10.2013 within time bound period."

Heard Sri P. Raghavendra Rao, learned counsel for the petitioner and Smt. J. Koteswari Devi, learned Standing Counsel for Southern Power Distribution Company Limited, appearing for the respondents.

When the matter is taken up, it is submitted by the learned counsel for the petitioner so also the learned Standing Counsel appearing for the respondents that the issue in the present Writ Petition is squarely covered by the order of this Court in Writ Petition No.33771 of 2011 dated 22.12.2011. A copy of the same is also placed on record along with the Writ Petition as a material paper. The operative portion of the said order reads as under:

AVSS, J W.P.No.5789 of 2017 "At the hearing, when this Court has asked Sri O. Manohar Reddy, learned Standing Counsel, as to whether any ex gratia is paid to the petitioners, he submitted that ex gratia is payable depending upon the cause of the death and that the respondent will consider the petitioners' claim for payment and take a decision. This submission of the learned Standing Counsel is placed on record and the respondent is directed to consider award of ex gratia to the petitioners in terms of the extant regulations/circulars, within a period of one month from the date of receipt of this order and communicate the decision to the petitioners."

Following the above said order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof.

Office to enclose a copy of the order, dated 22.12.2011 in Writ Petition No.33771 of 2011, to this order. Consequently, Miscellaneous Petitions, if any pending in this Writ Petition, shall stand closed. No order as to costs. _________________ A.V.SESHA SAI, J 20th FEBRUARY, 2017.
