THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17075 of 2016 ORDER:

This writ petition is filed complaining inaction on the part of respondents 2 and 4 on the complaint of the petitioner that the 3rd respondent is illegally excavating the earth from the village tank situated at Chamallamudi Village of Vatti Cherukur Mandal, Guntur District, which belongs to the 2nd respondent-temple. Learned counsel for the petitioner submits that in identical case in W.P.No.7055 of 2016 this Court granted interim order in favour of the petitioner therein in relation to the land in adjacent survey number. On the other hand, Smt.K.Lalitha, learned Standing Counsel appearing for 2nd respondent, on instructions, submits that as on date, no permission to anyone has been granted for excavating the earth from the said tank.

Recording the said submission of the learned Standing Counsel, this writ petition is closed. However, liberty is given to the petitioner to approach the Court if he is otherwise aggrieved in future. There shall be no order as to costs.

Consequently, miscellaneous petitions pending in the writ petition, if any, shall stand closed.
