THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.365 of 2017 JUDGMENT:

This appeal is filed, under section 100 CPC, assailing the judgment and decree dated 15.07.2016 in A.S.No.329 of 2010 on the file of XIII Additional District Court, Ranga Reddy District at L.B.Nagar, wherein whereby the decree and judgment dated 19.10.2010 in O.S.No.1698 of 2004 on the file of II Additional Junior Civil Judge Court, Ranga Reddy District, at L.B.Nagar, dismissing the suit filed by the plaintiff for recovery of possession of the suit schedule property, was reversed.

No representation on behalf of the appellant on 22.10.2018. Today also no representation on behalf of the appellant even though the matter is listed under the caption 'for dismissal'. Learned counsel for the first respondent-plaintiff present on 22.10.2018 and today also. It seems that the appellant is not interested to prosecute the matter.

Hence, the appeal is dismissed for non-prosecution. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
