THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1476 OF 2016 ORDER:

This Criminal Revision Case is filed by the petitionerhusband seeking to set aside the order of the Additional Judicial Magistrate of First Class at Bhongir dated 13.5.2016, whereby the learned Magistrate issued Non-Bailable Warrant against the petitioner in Crl.M.P.No.2365 of 2015 in M.C.No.2 of 2012. Heard the learned counsel for the petitioner and learned Additional Public Prosecutor. Perused the material on record. In the circumstances of the case, the petitioner is directed to surrender before the Court below and file an application seeking to recall the warrant. On filing such application, the Court below is directed to recall the Warrant issued against the petitioner on the same day on condition of petitioner depositing half of the arrears of maintenance amount before it on or before 30th June, 2016. In default, the trial Court is at liberty to proceed against the petitioner in accordance with law. Till such time, the execution of N.B.Ws. is hereby suspended.
