HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 12565 of 2005 Order:
This Writ Petition was filed for the following relief. "To issue an appropriate writ more particularly one in the nature of Writ of Mandamus, declaring that the accepting of the bid of the 3rd respondent by 1st and 2nd respondents in respect of Shop No.129 of Kottam village, S.Kota, Vizianagaram District and allotting the said shop to him pursuant to notification in G.O.No.22 of 2005, dated 26.05.2005 as illegal, null and void and contrary to Rule 6(ii) and 10 of the A.P. Excise (Lease of Rights of Selling by Shop and Conditions of Licence) Rules 2005 or Condition 1(ii) of auction conditions and consequentially direct the respondents 1 and 2 to set aside the allotment in favour of the 3rd respondent and direct the respondents 1 and 2 to re-auction the above said Shop No.129 calling fresh tenders."
2. In view of the nature of relief sought in the writ petition and taking into consideration the long lapse of time, nothing survives for adjudication in the writ petition and the matter has become infructuous.
3. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
4. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
