HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.26064 of 2019 ORDER :

This writ petition is filed seeking Mandamus to declare the action of the respondent Nos.2 to 4 in taking steps to permit the 5th respondent to open new Wine Shop license bearing No.52 at Marrichettu Junction of Manikonda Municipality, Rajendra Nagar Mandal, Ranga Reddy District, as the said shop is situated midst residential locality, educational institutions and temples and as the 5th respondent constructed the said shop without any permission from the Municipality only for the establishment of Wine Shop without considering the objections of the petitioners and also objection of Nava Jyothi Yuvajana Sangam, as illegal, unlawful, contrary to law and consequently direct the respondents not to permit the 5th respondent to open his Wine Shop at the above premises at Marrichettu Junction of Manikonda.

When the matter came up for hearing, learned Government Pleader for Excise has produced a copy of written instructions before this Court, the relevant portion of which reads as under:

"The Commissioner of Prohibition and Excise, Telangana State vide Cr.No.2901/2019/CPE/TS/F1, dt.21.11.2019 has issued orders for shifting of A4 shop premises from

ARR,J W.P.No.26064 of 2019 existing premises at Plot No.1, Sy.No.16/3, 135/Part, 136/Part, 13/Part and 144/Part and part of Plot No.50, Sy.No.12/Part, 14, 15, 16/2, 137 part, 138 part, 141 part and part of Manikonda village of Manikonda Municipality, Gandipet Mandal of Ranga Reddy District, to newly proposed premises at Sy.No.264/e, Manikonda Main Road, Opp: Lanco Hills, Manikonda Municipality, Gandipet Mandal, Ranga Reddy District, subject to payment of Rs.10,000/- towards shifting Excise Tax as per the Circular instructions of the Commissioner of Prohibition and Excise, Telangana State vide Cr.No.3060/2017/CPE/TS/F1, dt.30.10.2019 and requested to take necessary action as per Rules."

Learned counsel for the petitioners submits that in view of the subsequent events, no further orders are required in the present writ petition.

Recording the said submission, this writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
