THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.28570 OF 2017 ORDER:

This Writ Petition is filed alleging that illegally and highhandedly the respondent authorities are trying to dispossess the petitioners from the land to an extent of Acs.2.04 cents in R.S.No.513/1 of A. Konduru Village and Mandal, Krishna District. Petitioners claim that the said land is their private patta land and respondent authorities cannot interfere with their possession and enjoyment. The grievance of the petitioners is that without following due process of law, they are sought to be evicted from the subject land by the respondent authorities.

According to learned counsel for the petitioners, in April, 2015, orders were passed by the competent authority for conversion of agricultural land into non-agricultural purpose and thereafter appropriate steps were taken for development of the land for construction of sheds. At this stage, respondents are sought to interfere with the possession and enjoyment of the petitioners without following due process.

The Tahsildar, A.Konduru, Krishna District, furnished instructions dated 28.08.2017 to learned Government Pleader for Revenue, wherein it is stated that the land to an extent of Ac.1.98 cents is classified as Gayalu and the said land is under encroachment of SIEC Indo Private Limited and they got orders of conversion of land to an extent of Ac.0.71 cents in the year 2015. It is further stated that the Tahsildar would take appropriate action by following due procedure as required by law.

In view of the categorical statement of the Tahsildar, A. Konduru, Krishna District, that he would follow due procedure as required by law to evict the petitioners, the grievance of the petitioners does not subsist any more.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
