THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42880 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the action of respondent No.3 in not arresting accused Nos.4 to 9 in Crime No.300 of 2012 on the file of Falaknuma Police Station, Hyderabad and not filing charge sheet as illegal and arbitrary and consequently, direct respondent No.3 to complete the investigation and file charge sheet by arresting accused Nos.4 to 9 in the said crime. 2.

Heard and perused the material available on record. 3.

Case of the petitioner is that basing on a complaint lodged by him, respondent No.3 registered the aforementioned case for the offences punishable under Sections 468, 471 and 420 read with 34 I.P.C., but respondent No.3 filed charge sheet against A-1 to A-3 only and not filed charge sheet against A-4 to A-9 and hence, prays to give a direction to respondent No.3 to complete the investigation in the said crime and file charge sheet against A-4 to A-9. 4.

Learned Assistant Government Pleader for Home submitted that respondent No.3 is meticulously investigating the matter and he is trying to arrest A-4 to A-9 and after completion of the investigation, he will file charge sheet against A-4 to A-9 also. 5.

Recording the submission of the learned Assistant Government Pleader, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
