THE HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.5490 of 2009 ORDER:

The defendant in O.S.No.129 of 2009 is the revision petitioner.

The revision is directed against the order dated 26.10.2009 in C.M.A.No.22 of 2009 to the limited extent of directing both the parties to maintain status-quo till disposal of the suit. The revision petitioner filed C.M.A.No.22 of 2009 against the order in I.A.No.703 of 2009 before the Court of Senior Civil Judge, Chirala. The learned Judge substantially agreed with the case of revision petitioner and allowed the C.M.A. However, without assigning particular or special reasons directed the parties to maintain status-quo till disposal of the suit. Hence, the Civil Revision Petition.

On 05.12.2009 while admitting the Civil Revision Petition suspended the direction given by the appellate court to maintain status-quo till disposal of the suit. Learned counsel for petitioner submits that the suit is ripe for trial and appropriate direction may be given to the trial Court to dispose of the suit expeditiously.

Under the above circumstances, the interim order dated 05.12.2009 is made as final order in the Civil Revision Petition. The trial Court is directed to dispose of the suit as expeditiously as

possible preferably within two months from the date of receipt of a copy of this order.

The Civil Revision Petition is accordingly disposed of. No order as to costs.
