HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.1 and 2 of 2019 In/and CRIMINAL PETITION No. 7615 of 2019 ORDER:

The petitioners, who are A1 to A6 filed this Criminal Petition under Section Cr.P.C.

to quash the proceedings in Cr.No.207 of 2019 on the file of the Women Police Station, Charminar, Hyderabad, registered for the offences punishable under Sections 498-A, 406 and 506 IPC and 4 and 6 of D.P. Act.

2. During the pendency of the criminal petition, the 2nd respondent/de facto complainant filed I.A.Nos. 1 and 2 of 2019 to record the compromise and to compound the offences. Along with the petitions, a joint memo came to be filed, which is supported by the affidavit of the second respondent. The 2nd respondent also filed Memo of Understanding, which forms part of the compromise. According to the M.O.U. the petitioners-accused shall have to be pay a sum of Rs.2,10,000/- towards full and final settlement for dissolution of marriage. At the time of execution of MOU, the petitioners have already paid a sum of Rs.1,00,000/- by way of cash and a sum of Rs.1,10,000/- through cheque bearing No.000001 drawn on Kotak Mahendra Bank and handed over the same to the de facto complainant. Apart from this, the 1st petitioner-A1

has also agreed to give the gold ornaments weighing about 2.5 tulas and the same is also handed over to the de facto complainant, which she has acknowledged to receive the cash as well as gold ornaments. Therefore, it is prayed to record the compromise and quash the proceedings.

3. Today, both the parties are present before this Court and submitted Aadhar cards, which show their identity. They are also identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the proceedings against the petitioners.

4. In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.Nos.1 and 2 of 2019 are ordered.

5. Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in Cr.No.207 of 2019 on the file of S.H.O. Women Police Station, Charminar, Hyderabad City, against the petitioners-A1 to A6 are hereby quashed. Miscellaneous petitions, if any pending shall stand closed.
